SPRINT Photography - TERMS OF USE
This site is owned and operated by SPRINT Photography .
Your use of this website and any materials available herein identifies that you agree to the following terms of use (hereinafter referred to as the ‘Terms of Use’). If you do not agree to these terms, then you should leave this website (hereinafter referred to as the ‘Site’) immediately and not use any of the materials available on the Site.
COPYRIGHT MATERIALS
’Materials’ shall constitute and be defined as any files, images, animations, photographs, or text available on the SPRINT Photography Site.
All Materials downloaded from the SPRINT Photography Site remain the copyright property of SPRINT Photography. As part of your purchase, SPRINT Photography grant you a royalty-free license to use the Material that you have purchased. Downloading these Materials does not transfer any title for these Materials to you, or any intellectual property rights.
The design and layout, as well as all Materials provided on the Site, is protected by the United States and International law and other intellectual property proprietary rights and may not be copied or imitated in whole or in part.
USAGE RESTRICTIONS
There are two classes of Material usage provided by SPRINT Photography. These are Personal Use and Commercial Use. Unless otherwise specified and agreed, Personal Use is applicable to all Materials purchased from the SPRINT Photography Site.
The following terms apply to both Usage classes:
- Unless explicitly agreed with SPRINT Photography, you may not redistribute or sell these Materials at any time.
- It is illegal to duplicate or distribute any Materials from SPRINT Photography, except for the use of the Purchaser as per the Usage class conditions below.
- Digital copyright information must not be altered or removed from Material (i.e. digital metadata must remain embedded with the Material, where it is originally present upon purchase)
- Usage rights are not transferable from the Purchaser to other parties.
USAGE RESTRICTIONS – PERSONAL USAGE
The following additional terms apply to Personal Usage, in additional to the base terms:
- Material must not be used for Commercial purposes (including, but not limited to, relating to generating income, or in connection with any business)
- Possible personal Usage include: personal not-for-profit websites, social networking websites, screen savers, printing for personal use.
USAGE RESTRICTIONS – COMMERCIAL USE
The following additional terms apply to Commercial Usage, in additional to the base terms:
- Commercial Usage must be explicitly agreed by SPRINT Photography, and incurs an additional purchase cost
- Material may be used for Commercial purposes (including, but not limited to, relating to generating income, or in connection with the business of the Purchaser). Possible Commercial uses include corporate websites, corporate brochures and other corporate marketing material relating to the business of the Purchaser
- A visible "© SPRINT Photography" annotation must be displayed at the bottom of all images that are used for Commercial purposes. Images will be provided with this annotation, which must be displayed whenever the images are used Commercially
- Reasonable efforts must be made by the Purchaser to protect SPRINT Photography's copyright and distribution rights when the images are used electronically - for example, disabling of "right click" website functionality that allows "save as" / "copy" functionality, or using low-resolution images (maximum 1024 x 768 pixels)
LIMITATION OF WARRANTY
SPRINT Photography makes no representation or warranty with respect to any product or the related documentation and to the extent permitted under applicable Law the Site is delivered "as is". The warranty stated herein is expressly in lieu of all other warranties, express or implied, including but not limited to any express or implied warranty of accuracy, correctness, reliability, merchantability, fitness for a particular purpose, and non-infringement, and such warranty constitutes the only warranty made by SPRINT Photography with respect to the site, content and materials.
SPRINT Photography does not warrant that the content or functions contained in the site will be free from errors, interruptions, omissions, defects, viruses, or other damaging elements, or that SPRINT Photography will correct any errors, omissions or defects identified. You assume the cost of service, repairs or corrections to your hardware, software or other equipment.
LIABILITY AND DAMAGES
In no event will SPRINT Photography or any of its affiliates, officers, directors, employees, licensers, suppliers or distributors be liable for any indirect, special, incidental, economic, or consequential damages arising out of the use or inability to use the Site or Materials, even if SPRINT Photography has been advised of the possibility of such damages. In no event will liability of SPRINT Photography or any of its affiliates, officers, directors, employees, licensers, suppliers or distributors exceed the amount paid by you, if any, for accessing or using this Site, or purchasing or downloading Materials from this site. Because some legal jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
SCOPE OF UNDERSTANDING
These Terms of Use contain the entire understanding of the parties hereto relating to any use of this Site and its contained Materials, and supersedes any prior written or oral agreement or understandings between the parties with respect to this Site, and cannot be changed or terminated orally.
VALIDITY
The invalidity or unenforceability of any provision of these Terms of Use will not affect the validity or enforceability of any other provision of these Terms of Use.
FAILURE TO COMPLY
SPRINT Photography reserves the right to modify or terminate these Terms of Use without notice if, at SPRINT Photography’s sole discretion, you fail to comply with any term of these Terms of Use. Upon termination, you must destroy all Materials obtained from this Site, including copies and related documentation thereof.
CONTINUITY OF SERVICE
SPRINT Photography reserves the right to terminate this Site without notice.
